Lightfeet Terms of Supply

When you (You, your) purchase any Products from Interpod Pty Ltd (ACN 086 495 954) through its brand name Lightfeet (Interpod, Lightfeet, we, our, us) using lightfeet.com/au/ (Website), in addition to the Terms of Use, you agree to abide by the following Terms of Supply relating to the sale of our products (Terms of Supply).

Buy 2 Get 1 Free Promotion

“Sitewide Buy 2 Pairs – Get 1 Pair Free” promotion will run from 00:01 on 1st December 2023 – 11:59pm 7th January 2024 AEDT.

This promotion is only applicable to Lightfeet socks, insoles, footwear and hats, it does not include any other product (eg Gift Vouchers).

This promotion cannot be used in conjunction with any other offer, coupon or discount.

This promotion is available online only at lightfeet.com/au/

Discount will be applied to the lowest price item added to cart.

Lightfeet reserves the right to amend or end the promotion at any time.

Orders

Acceptance of Orders

You warrant that all information you supply to us at the time of placing an order (Order) for products that are offered for sale by us through the Website (Products) and in connection with an Order made using the Website, is true and correct.

By placing an Order you are offering to purchase a product on, and subject to the following Terms of Supply.

Your receipt of an Order confirmation does not indicate our acceptance of your Order and it does not confirm our offer to sell. Lightfeet has the right to accept or decline your Order at any time after receipt of your Order. All Orders placed must obtain pre-approval with an acceptable method of payment of Lightfeet. We may require additional verifications or information before accepting any Order.

Lightfeet reserves the right to refuse any Order without giving reason. If we cancel an Order, we will make all reasonable attempts to contact you using the details provided. All received monies will be refunded using the method of payment received.

Errors

We may correct any errors which appear on the Website and reject any Orders which have been received in connection with such errors.

Lightfeet has the right to refuse or cancel any Orders placed for Products listed at the incorrect price.

Lightfeet’s right to refuse or cancel any Orders will apply whether or not the Order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your Order is cancelled, Lightfeet will immediately issue a credit to your credit card account in the amount of the charge.

Change of Address

Lightfeet cannot be held responsible for an incorrect address being entered on your Order. If you complete your Order and then notice that the address details are incorrect, please contact Lightfeet immediately info@lightfeet.com

Payment

You must pay Lightfeet for the Products at the time of placing your Order using the Website. Lightfeet accepts Visa, MasterCard and PayPal. You must comply with the terms and conditions of these providers.

If you elect to pay by Visa, MasterCard or PayPal, charging or debiting of your payment card will only be made when you elect to pay for the items you have ordered at the end of the check-out. Prior to this step, your Order will not be recorded or processed.

Upon receiving your Order we carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to fulfil the transaction. Goods will not be dispatched until this pre-authorisation check has been completed. If the issuer of your payment card refuses to, or does not authorise payment for any reason, then you will be notified of this immediately prior to completing your purchase using the Website at the check-out stage. Your card will be debited once the Order has been accepted.

Overseas Orders

Lightfeet does not convert the total price of Orders into other currencies. We will bill your credit or debit card or PayPal account in Australian dollars and the card company or PayPal will convert the charges for you. If you have any questions about currency conversions please contact your bank or financial institution.

The actual price charged to overseas customers will be subject to the exchange rate applied by the customer’s credit or debit card company at the time the Order is processed.

Customs


Customers outside Australia may also be liable for any customs and import duty, quotas, permits, product restrictions and other local requirements. These charges must be paid by the person who placed the Order.. Customs policies vary widely from country to country. Therefore we suggest that you check the requirements in your country before placing an order. We will not be liable for any custom or import duties. Please refer to the Customs Tariff Act 1995 for tariff classifications, duty rates, interpretive rules and information on preference schemes, other concessions and exemptions that may apply to your goods.

Discount Codes

Account discount codes may be offered to account holders or selected buyers from time to time. These discount codes are only redeemable by the registered account holder and are only available for use until the lapse of the expiry date of those discount codes.

Promotional discount codes may be offered from time to time on certain products. These discount codes will be available for a limited amount of time only.

The entire amount of any discount code must be used in one single transaction. Refunds will not be given for any leftover value. Discount codes do not cover the cost of shipping unless stated otherwise.

Security

Your credit card details are not stored by the Website, they are passed securely through eWAY’s online payment gateway. All supplied sensitive credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our Database.

When placing an Order, you undertake that you are an authorised user of the credit or debit cards, or alternative method of payment, used to place your Order. If you are not the cardholder listed on the credit card, do not make a purchase using the Website. Lightfeet will report any instances of credit card fraud to the Australian Police, banking authorities and/or financial institutions.

In assessing your request for goods or services, we may use your information for the purposes of the prevention and detection of fraud.

Returns

Customer satisfaction is important to us. If you are unhappy for any reason, you may return the product to us within 21 days of receiving the order.

Please check your delivery carefully to ensure the product delivered matches your order and is not damaged. It is important to note that due to the robust nature of the product, damage incurred to the packaging does not necessarily mean damage to the actual product.

Limitation of Liability

To the extent not prohibited by law, in no event shall Lightfeet be liable for personal injury, or any incidental, special, indirect, or consequential damages whatsoever, including, without limitation, damages for loss of profits, loss of data, business interruption, or any other commercial damages or losses, arising out of or related to your use or inability to use the Products, however caused, regardless of the theory of liability (contract, tort, or otherwise) and even if Lightfeet has been advised of the possibility of such damages.

Some jurisdictions do not allow the limitation of liability for personal injury, or of incidental or consequential damages, so this limitation may not apply to you. In no event shall Lightfeet’s total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount you have actually paid to Lightfeet for the Products. The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.

Australian Consumer Law

In Australia, statutory consumer protection laws including the Competition and Consumer Act 2010 (Cth) give you rights which cannot be excluded, including consumer guarantees as to merchantability, fitness for purpose, supply by description, repairs, and title. The preceding terms of supply are subject to the rights you have under that legislation.

If Lightfeet is liable to you under the Competition and Consumer Act 2010 (Cth) or similar state legislation, to the extent to which Lightfeet is entitled to do so, Lightfeet limits its liability in respect of any claim under those provisions to: in the case of goods, at Lightfeet’s option: the replacement of the goods or the supply of equivalent goods; the repair of the goods; the payment of the cost of replacing the goods or of acquiring equivalent goods; and, in the case of services, at Lightfeet’s option: the supplying of the services again; or the payment of the cost of having the services supplied again.

Lightfeet Pricing Policy

All of our prices are in Australian dollars (AUD). For Australian orders our prices will show the additional GST charge. For overseas orders the prices exclude GST (Goods and Services Tax), local taxes or duties in country of destination if they are applicable.

Lightfeet regularly reviews pricing within the footwear accessory industry to provide our customers with the latest, competitive prices. Product prices are dynamically updated by our in house purchasing system when price changes are received from our suppliers. If you find a cheaper advertised price somewhere else, email or phone us with the details of the supplier together with prices of the product required and we will endeavour to provide you with a more competitive price.

Follow Up Emails

We may send out an email after your sale is completed in order to elicit a review of your purchased products. This email may come from a third party email address via the Customer Reviews service CusRev.

You are under no obligation to review our products, however if you enjoy your Lightfeet products then your review would be appreciated.

Mobile Terms of Service

The Lightfeet mobile message service (the "Service") is operated by Lightfeet (“Lightfeet”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Lightfeet’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Lightfeet through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, information, order status, delivery notification, abandoned cart, account creation, account activation, security and account alerts, password resets, and multi-factor authentication (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, abandoned cart, sales, discounts, special offers, product launches, giveaways, coupons, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Lightfeet. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to Lightfeet or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Lightfeet mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
